CRA penalties & notices

Can a business deduct a GST/HST filing penalty on its income tax return?

Check CRA’s specific treatment of GST/HST filing penalties and keep the assessment distinct from the tax balance and ordinary business expenses.

Read the charge before deciding its treatment

CRA's GST/HST filing-penalty guidance states that no income-tax deduction can be claimed for a penalty paid or payable for failing to correctly file a GST/HST return. A payment from a business bank account does not by itself establish deductibility.

This article concerns that specific type of penalty. It does not determine the tax treatment of every interest amount, fee, assessment or expense. Ask the preparer to identify what the notice actually charges.

Keep the assessment and payment together

  • Identify the GST/HST account and reporting period.
  • Keep the assessment or notice describing the charge.
  • Distinguish the penalty from the underlying tax and other amounts.
  • Retain the payment reference and account confirmation.
  • Have the accounting treatment reviewed with the bookkeeping records.

A bank entry labelled “CRA” may include more than one type of amount. Give the preparer enough information to understand the transaction rather than treating the description as the full accounting record.

Relief and deductibility are separate questions

If you believe a penalty warrants review, consider the appropriate CRA process with your adviser. Recording or paying the amount does not decide whether relief will be granted. Keep any request and decision with the original notice.

Use the calendar to keep the next period organized

In Compliance Calendar, record filing progress and payment references separately, with a note identifying any penalty follow-up. Keep the original assessment in your records. The product organizes preparation and evidence; it does not classify expenses or prepare an income tax return. Reminders can support an earlier handoff without guaranteeing that penalties will be avoided.

Common questions

Does paying the penalty through the business make it deductible?

That alone does not determine tax treatment. CRA specifically disallows an income-tax deduction for the GST/HST filing penalty described here.

Does this article decide the treatment of every CRA charge?

No. Identify the actual charge and have its treatment reviewed by the preparer.
